These general conditions of sale govern the sale of products marketed on www.makentaste.com
IDENTITY OF THE SUPPLIER
The company supplying the items marketed on the website www.makentaste.com subject to the orders is:

The Customer can purchase the products on www.makentaste.com by using their VISA, Mastercard American Express, Diners Club or JCB credit or debit card; or Apple-Pay or Google-pay applications, as indicated in the purchase procedure.
All prices are inclusive of the statutory VAT.
PRISMA SRL assumes no responsibility for inefficiencies attributable to fortuitous events and/or force majeure, or in any case not attributable to the Seller, such as, by way of example, accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods and other similar events that may prevent the execution of the contract, in whole or in part, within the agreed time.
PRISMA SRL shall not be liable to any party or third parties regarding damages, losses and costs incurred as a result of non-performance of the contract for the aforementioned causes, with the consumer entitled only to refund of the price paid.
Delivery will take place on behalf of PRISMA SRL by couriers and/or forwarding agents in the ordinary times necessary for them.
OBLIGATIONS OF THE CUSTOMERS
It is forbidden for minors to place an order on the Website.
The data entered during the purchase phase must exclusively be the Customer’s real personal data and not that of third or invented parties.PRISMA SRL reserves the right to prosecute any violation or abuse and protect the interests of all consumers.
The Customer relieves PRISMAS SRL from any responsibility deriving from incorrect tax documents being issued, due to errors in the data provided by the customer, they themselves being solely responsible for providing the correct data.
Only quality products are on sale on the website www.makentaste.com, the storage, handling and transport methods being such as to preserve the good characteristics of the product. Upon receipt of the product delivered to them, the customer is required to verify its conformity with the order placed; only after this verification, and obviously without prejudice to the right of withdrawal provided for in the following point, the customer must sign the documents for the receipt of the goods.
RETURNS AND REFUNDS
The customer of PRISMA SRL who acts as a Consumer is granted the right of withdrawal from the contract, as provided for by the Consumer Code. It should be noted that this right is reserved only to natural persons, i.e. private consumers acting for purposes outside their profession. There is no right of withdrawal for legal and natural persons acting in a professional context, with reference to the purchase contract.
To exercise the right of withdrawal, the consumer who has made a purchase must communicate their desire to withdraw from the purchase to the email address email@example.com within 14 (fourteen) working days from the date of receipt of the products sent by PRISMA SRL.
Once the communication has been received, PRISMA SRL customer services will quickly contact the customer, informing them of how to return the purchased goods. Upon receipt of the instructions, the customer must promptly ship the goods, taking care to carefully pack them, where possible by inserting them in an external box to avoid damaging the original packaging with adhesive tapes, labels, etc. The product must be returned intact in the original packaging, complete with all its parts and accessories, including any free gifts received.
The shipping costs and the responsibility of the goods during shipment, as required by law, are borne by the customer: it is therefore advisable to insure the products during shipment with the chosen courier.
RESTRICTIONS ON RETURNS AND REFUNDS
In case of damage during transportation when returning the goods, PRISMA SRL will notify the Customer within five working days of receipt of the goods, allowing them to file a complaint with the courier used for the transportation. Damaged goods will be made available for return, and the request for withdrawal will be cancelled at the same time.
After receipt of the goods in the warehouse, PRISMA SRL will check their integrity and/or for any defects that were the cause of the return. Once the integrity of all the components of the product and the related accompanying elements has been verified, PRISMA SRL will proceed with the reimbursement of the amount paid, with the exception of shipping costs; the refund will be made within 14 days of the above checks.
The right of withdrawal lapses completely should the product be returned not intact, i.e.:
1. Without the original packaging
2. With any integral elements of the product missing.
3. With damage to the product attributable to any cause other than shipping.
The right of withdrawal does not apply to the supply of food which, by its nature, cannot be returned or is liable to deteriorate or expire rapidly.
The right of withdrawal is excluded in the following cases, pursuant to art. 59 of Legislative Decree 21/2014:
– order of products by a Customer who is not a consumer and/or who requests an invoice
– order of products that are likely to deteriorate or expire rapidly;
– order of sealed products that are not suitable to be returned for hygienic reasons or reasons related to health protection or that have been opened after delivery.
With reference to the cases where the right of withdrawal is not be applicable, the Customer is specifically informed and accepts the fact that the products that are “likely to deteriorate or expire” shall include all food products, since the characteristics and the quality of these types of products is subject to alteration, also as a consequence of inappropriate storage. Therefore, for reasons of hygiene and customer protection, the right of withdrawal is only applicable for products purchased on the website that can be returned to PRISMA SRL, Strada di Cerchiaia 41 -SIENA 53100 (Italy) and put back on the market without danger for consumer health (such as gadgets, tools, etc.).
Lack of conformity
In case of lack of conformity of Products sold by PRISMA SRL , the Customer must immediately contact the email address firstname.lastname@example.org reporting the problem and follow the instructions that will be communicated to them
The sale of Products is covered by the legal safeguards laid down in Articles 129, 130 and 132 of the Consumer Code. The Customer has the right to remedy the conformity of the goods, without charge, by repair or replacement, or with a suitable reduction in the price or termination of the contract. The Customer loses these rights if they do not report the lack of conformity to PRISMA SRL within two months from the date on which they discovered the defect.
